Terms of service

These terms are an agreement between you and Manuel Ortuno, Playa Grande, Cabo Velas, Santa Cruz, Guanacaste, Costa Rica ("Glassy", "we"). By creating an account or using Glassy you agree to them and to the Privacy Policy. If you use Glassy for a company or a client, you confirm you are authorized to accept these terms for them, and "you" includes them.

1. Who can use Glassy

You must be at least 18 years old and able to form a binding contract. Glassy is a professional tool for creators, businesses and agencies.

2. The service

Glassy helps you plan, publish and measure social media posts, answer comments and messages, and keep track of your time. Features may change, and during the pilot some may be experimental. We may add, change or remove features; if we remove something material you pay for, we will tell you in advance.

3. Your account

Keep your sign-in details secure and tell us at support@glassyhq.com if you suspect misuse. You are responsible for activity under your account and for the people you invite to your workspaces. We recommend turning on two-factor sign-in.

4. Connected platforms

When you connect a social media account, you authorize Glassy to act on it as you direct: to publish, read and reply to comments and messages, and read insights. Your use of each platform remains subject to that platform's own terms and policies (for Instagram, the Instagram Terms of Use and Community Guidelines, and Meta's policies). Platforms can change, limit or withdraw their APIs, reject or remove content, or restrict accounts at any time; we are not responsible for their decisions, and features that depend on them may stop working. Glassy is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc. or any other platform.

5. Your content

You keep all rights to the content you create and upload. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display it only as needed to run Glassy for you (for example, to send it to the platforms you choose and to show it on your link page). You are responsible for your content, including posts, automatic replies and messages sent by rules you set up, and your link page, and you confirm you have the rights to it and that it does not break the law or anyone's rights.

6. Acceptable use

Do not use Glassy to: send spam or unsolicited bulk messages; harass, threaten or impersonate anyone; post illegal, deceptive or infringing content; mislead people about prices, results or endorsements; collect other people's data beyond what you need to reply to them; break any platform's rules (including messaging limits and automation rules); interfere with, probe or overload Glassy or try to access other people's data; or resell Glassy without our agreement. We may suspend or remove content or accounts that break these rules, and will tell you why unless the law or safety prevents it.

7. The writing assistant

The assistant uses an AI model to draft text. Drafts can be wrong, incomplete or unsuitable, and may resemble text written for others. Review and edit every draft before you use it; you are responsible for what you post or send. As between you and us, you own the drafts you choose to use. Do not enter sensitive personal data. We may set usage limits to control cost and abuse.

8. Workspaces, teams and agencies

The owner of a workspace controls it, including who can access it and its data. If you manage accounts for clients, you are responsible for having their authorization and for your agreements with them. Where you use Glassy to process personal data of others (for example your clients' followers) and the law requires it, our Data Processing Addendum forms part of these terms.

9. Plans, payment and cancellation

Paid plans are subscriptions billed in advance, monthly, through Stripe, at the price shown when you subscribe, plus applicable taxes. Subscriptions renew automatically each month until you cancel. You can cancel at any time in Settings, Manage billing; cancellation takes effect at the end of the current paid period, and you keep access until then. Except where the law requires otherwise, payments are not refundable and we do not refund partial periods. If you are a consumer in the EU or UK, you may have a 14-day right of withdrawal; by starting your subscription immediately you ask us to begin the service during that period and accept that, if you withdraw, you pay for the part already provided. We may change prices with at least 30 days' notice before your next renewal; pilot members keep their pilot price for as long as their subscription stays active without interruption. If a payment fails, we may limit paid features until it succeeds.

10. Pilot and free use

Free, pilot and trial access is provided as is, may be changed or ended at any time, and may have limits.

11. Ending the agreement

You can stop using Glassy and delete your account at any time in Settings. We may suspend or end your access if you materially break these terms, if required by law, or if a platform requires it; where reasonable we will give notice and a chance to export your data. When your account is deleted, your data is deleted as described in the Privacy Policy. Sections 5 (license, to the extent needed to complete deletion), 12 to 16 survive.

12. Disclaimers

Glassy is provided "as is" and "as available". We work hard to publish every post on time and to report problems, but we do not guarantee that the service will be uninterrupted or error-free, that every post will publish at the exact scheduled time, that platforms will accept your content, or any results, reach, growth, revenue or time savings. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of liability

To the extent the law allows: (a) neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, followers, data or goodwill; and (b) our total liability for all claims relating to Glassy is limited to the greater of the amounts you paid us in the 12 months before the event giving rise to the claim, or USD 100. These limits do not apply to liability that cannot be limited by law, such as for fraud, gross negligence or wilful misconduct, or to consumers' statutory rights.

14. Indemnity

If you use Glassy for business, you will defend and indemnify us against third-party claims arising from your content, your automatic messages, your breach of these terms or of a platform's rules, or your violation of anyone's rights, and related reasonable costs.

If you believe content shown through Glassy (for example on a link page) infringes your rights, send a notice to Manuel Ortuno at hello@glassyhq.com with the work, the content and where it appears, your contact details, a good-faith statement and your signature. We will act on valid notices and may remove repeat infringers.

16. Governing law and disputes

These terms are governed by the laws of Costa Rica, without regard to conflict-of-law rules. Before filing a claim, contact us at hello@glassyhq.com and we will try to resolve it informally within 30 days. Courts of San José, Costa Rica have exclusive jurisdiction, except that consumers may also bring claims in the courts of their country of residence and keep the protection of its mandatory laws.

17. Changes to these terms

We may update these terms. For changes that matter, we will update the version above and ask you to accept the new terms before they apply to you; if you do not accept, you can delete your account, and we will refund any prepaid amount for the period after the change.

18. General

These terms (with the Privacy Policy and, where it applies, the Data Processing Addendum) are the entire agreement between us about Glassy. If a provision is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them to a successor of our business. Neither party is liable for delays caused by events beyond its reasonable control.
